Customs and Transport Law

The customs authorities do not have a uniform position on this issue. Our practice is that the customs authorities’ positions are contradictory: in one case the customs authorities state that in the post-clearance audit procedure it is not possible to use evidence from other procedures (e.g., analysis of samples of the composition of goods from customs declarations that are not subject to the same post-clearance audit).

On the other side, we have cases where the customs authorities state that,evidence that was not presented in the specific post-clearance audit procedure, can be used in this the procedure. The answer to this question is essential when evaluating whether importers can be committed to paying customs debts three years back on the basis of evidence from other procedures, i.e., evidences which are not presented in a specific post-clearance audit procedure. To evaluate accuracy of data in customs declarations subject to control in the post clearance procedure, audit team is obliged to determine relevant facts and to present evidence supporting the facts exclusively in the respective post clearance procedure.

The previous Customs Law stipulated that incorrect tariffing of goods means entering a tariff heading that is different in relation to the data on the nature of the goods (Article 294, paragraph 1, item 5). The new Customs Law prescribes that incorrect tariffing is the presentation of incorrect or untrue data, i.e. acting in any other way (Article 267, paragraph 1, item 2).

The first-instance courts hold the charged legal entities not responsible for misdemeanourbecause the new Customs Law does not incriminate the action the entry of a tariff heading which is different in relation to the data on the nature of the goodsas misdemeanour. The courts refer to the case law of the highest court instance according to which “with the expiration of the law, the possibility of its application for acts undertaken during its validity does not cease if the new law treats the same act as punishable but with stricter penalties so that the law is not more lenient.”

In addition, the courts consider that the legislator, in the transitional provisions of the new Customs Law, was obliged to explicitly indicate that the misdemeanour under Article 267, paragraph 1, item 2 consumes the misdemeanourunder Article 294, paragraph 1, item 5 of the previous Customs Law. The Misdemeanour Court of Appeals does not share the opinion of the first instance misdemeanour courts. We believe that the Constitutional Court should remove this uncertainty and bring legal certainty to the business of importers and freight forwarders.

Recently, misdemeanour courts have been supporting the position that customs agents are responsible for presenting incorrect information, i.e. the accuracy of data in the customs declaration (incorrect tariffing). This position is explained in such a way that the customs agents participated in the customs clearance procedure, i.e. filled in the customs declaration, and that they are thus responsible for entering the tariff heading which was subsequently determined to be untrue.

On the other hand, the judgments of the misdemeanour courts state that importers (recipients of goods) cannot be responsible for the misdemeanour from Article 267, paragraph 2 of the Customs Law, because they were not the ones that entered the data in the customs declaration. At the same time, the courts consider that the fact whether it is a direct or indirect representation is not important for determining the responsibility for entering the data in the customs declaration. Article 12 paragraph 3 of the Customs Law, the violation of which is incriminated by Article 267 paragraph 2 of the Customs Law, prescribes that the declarant is responsible for the accuracy of the data in the customs declaration. The question is who is really responsible for the accuracy of the data in the customs declaration and who is considered to be the declarant referred to in Article 4, paragraph 1, item 15 of the Customs Law.

Refrigerated container shipping, commonly known as “reefer” shipping, allows for the efficient delivery of many products around the world while maintaining their quality and safety during transit.

Reefer containers are used in a variety of industries, including food, pharmaceuticals, and chemicals. Fruits and vegetables often require specific temperatures to prevent overripening or spoilage. Meat and fish require low temperatures to limit microbial growth and ensure food safety. Reefer containers are also used to transport temperature-sensitive pharmaceuticals.

Insulation is essential to keep the temperature inside the reefer container stable. Therefore, reefer containers are made of high-quality insulating materials and have special doors to prevent heat or cooling loss.

Sea shipping is a popular method of transportation when vehicles need to be moved across long distances, such as international shipments between different continents. If you decide to ship your company car by ship, then a closed container is the safest solution.

In addition to container transport, there are also so-called RO-RO ships (roll-on/roll-off ships), which are designed to transport “rolling” or wheeled cargo such as cars, trailers, etc. They have built-in internal ramps that allow the cargo to roll during loading and unloading, and the cars are secured on the open deck during transport. Although this solution is less expensive, it does not provide the same level of protection as container transport.

Inside the container, cars are protected from the weather, dust and road debris. Thus, container transport is frequently used for luxury, classic, old-timer, or high-value vehicles that require special care and protection while in transit. Vehicle preparation: It is importantto adequately prepare the vehicle prior to loading. This includes cleaning the vehicle, removing personal belongings, draining the fuel, and confirming that all vehicle components are working. A minimum fuel level reduces not only the weight of the shipment, but also the risk of potential damage.

Lashing and securing: Vehicles must be securely fastened during transit to prevent movement and damage. Special straps are used to further secure the vehicle inside the container.

Insurance: Because vehicles are valuable assets, they must be properly insured. Due to the increased risk of damage or theft, it is advisable to pay an additional fee for insurance.

When goods are imported for processing, i.e. when they undergo some kind of processing, repair, transformation, or value addition before being re-exported, companies are often exempt from paying duties or entitled to a refund. By taking advantage of these benefits, companies can lower their production costs and increase their competitiveness in the global marketplace.

This is also known as a “special purpose customs procedure” or “customs procedure for processing goods with re-export”. This customs procedure usually requires special permits, records and customs documentation to track the journey and processing of the goods. Failure to comply with this procedure can result in customs violations and fines.

Here are some important things to keep in mind:

Customs procedures:Familiarize yourself with all applicable customs procedures, including those relatedto import/export for processing in your country of origin.

Export of essential oils, mostly immortelle, basil and lavender, have experienced great expansion in recent years. Serbian essential oils have found their place in many pharmaceutical and cosmetic companies around the world.

Although apparently not, essential oils are treated as dangerous substances in transport due due to their chemical composition and biological activity. The main reason why they fall into this category is the low flash point. Some of the oils can ignite even at a temperature of 50 °C. Otherwise, the term hazardous substances means all substances that have such characteristics that they can cause consequences harmful to health and the environment. This is most often due to irresponsible and / or unprofessional handling, packaging, storage or transport.

Special attention should be paid to the transport of dangerous goods in terms of choosing transport means, technical and technological means of manipulation, environmental research, and especially the education of persons who come into contact with dangerous goods.Since the quantities of essential oils that are shipped are relatively small, and the product itself has a great value, they are most often transported by air.

A prerequisite for a transport company is to be registered for this type of service, and that its staff is certified and trained to handle hazardous materials. In case of air transportation that should be – IATA DGR – International Air Transport Association Dangerous Goods regulation, which is the main document at the global level when it comes to the safe air transport of dangerous goods.

At the same time, the manufacturer / consignor is obliged to provide the MSDS (Material Safety Data Sheet) issued by an authorized laboratory after performing the necessary analyzes. It is a technical document that contains all the relevant information regarding the substance being transported and, in fact, defines the level of danger to humans and the environment.

During a preparation of a shipment of essential oil for transport, special attention is paid to the packaging. Packaging instructions are included in the MSDS, and the procedure may only be performed by a certified person (the manufacturer or the agent representing him).

The process of packaging hazardous materials is a very sensitive segment and requires great attention, because it directly affects the safety aspect of transport. On that occasion, it is necessary to choose quality packaging with pre-tested performance prescribed by ICAO (International Civil Aviation Organization). In addition to the packaging itself, adequate marking and declaration is also necessary.

Numerous laws and standards govern the import and export of equipment, therefore it is crucial to abide by all of them when those things are being transported. If you don’t, you might face steep fines or even have your goods seized.

If for the purposes of filming you want to import audio or video equipment that you will subsequently return to your country after the work is completed, then it is a matter of temporary import/export of goods.

This type of import is treated differently because the goal is to avoid taxes and customs clearance costs with some assurance that the goods will subsequently be re-exported from the country.

An ATA Carnet is often recommended for use by film and TV companies shooting abroad. It is a physical document that you take with your goods when you are temporarily moving them out your country and into other countries, and it significantly reduces the difficulties

To obtain an ATA Carnet the foreign producer must provide a list of all the audiovisual equipment, their invoices and a deposit, if necessary.

However, it is important to note that you must not list any disposable or consumable equipment on your Carnet, such as non-rechargeable batteries, pens, paper, glue, bin bags, etc. These are not permitted on ATA Carnets, as there can be no guarantee that they will definitely return in the same condition.

The deposit amount varies according to the equipment’s country of origin.
Also there are countries which do not have the obligation of paying a deposit, but the relevant procedure must be followed at the destination country’s consulate.

  • Each carnet is valid for a temporary period of time, and the equipment must be taken back.
  • Goods cannot be sold or exchanged.
  • The same goods must be re -exported to the country of origin before expiration.
  • Goods cannot be rented, transferred or destroyed without the permission.
  • If we are talking about goods for which there is a ban on import/export, it is necessary to have an adequate license or permit.

It is imperative that you present your ATA Carnet every time the equipment is imported into, exported out of, or transited through a country.

According to studies, the global consumption of honey is increasing every year. Beekeeping is one of the oldest crafts in Serbia, and this year’s favorable acacia flowering conditions signal record domestic production. In the first 10 months of 2022, Serbia exported a total of 1,479 tons of honey. The main importers of Serbian honey are Germany, Poland, Belgium, and Spain. Despite its high production output, Serbia purchased around 485 tons of foreign honey from Moldova, Russia, Ukraine, and New Zealand. In the following section, we will discuss what you need to know if you plan to trade honey internationally.

Basics of storing and transporting honey

Honey is not as demanding as other foods such as meat and dairy products that spoil at sub-optimal temperatures. However, this does not mean that exporting honey is without its challenges. When honey is exposed to heat or moisture, its consistency changes, which means that if your final destination is in a country with high air humidity, it could result in a loss of product, flavor, and therapeutic properties. One way to avoid this is through efficient packaging. The best option is a sealed container because it protects the goods and prevents illegal access during transit.

A vehicle with an open load area can also be used, because honey does not require a strict temperature regime, but then the honey must be covered in order to prevent contamination with dust or insect attacks. We also recommend using thermal blankets to prevent severe temperature fluctuations in the vehicle and/or the warehouse. The best storage conditions are at room temperature and out of direct sunlight. In addition, honey cannot be transported or stored with items that have an overpowering odor. Honey may require more or less care in handling depending on whether it is packaged in glass, metal, or plastic.

Import of honey

The importer must be listed in the central register of food business establishments at the Ministry of Agriculture, Forestry and Water Economy of the Republic of Serbia, and the warehouse must be listed in the register of food business facilities at the same Ministry. In order to import honey into Serbia, you will also need documents proving compliance with veterinary and sanitary regulations.

Export of honey

Your destination country may have additional requirements that you must meet. Some countries have much stricter and less profitable requirements, which may eliminate them from your export list.

Importing used products might be challenging because their expected lifespan is much shorter than that of new products, which is why international trade in them is governed by the Waste Management Law in Serbia. The Ministry of Environmental Protection has specified the second-hand/used items for which an import permit is required.

Used construction and agricultural machinery are the most common items exported to the Balkan market, although there are other categories as well, such as second-hand clothing.

When importing used goods from other countries, the first step is to verify that you own the goods, and the next critical piece of information is their intended use.

Import of used machinery

When importing a used machine to be used as equipment in your business, the invoice is supported by SBRA (Serbian Business Registers Agency) documentation as proof that the machine is being purchased for the performance of the main activity. In the case of agricultural machinery, this meansproof of a registered agricultural holding. The machinery must be in goodworking order. If the import of certain equipment is subject to international trade policy measures (permits, import approvals), a permit from the relevant Ministry or state agency is required.

Transporting machinery requires a lot of technical knowledge. In addition to what we discussed in What information must be included when requesting a transport quote?, you will need to provide further information, such as whether side loading orwrenching isneeded to move the machine, whether the equipment contains oil, and so on…

As it is illegal to import substandard goods, you will also need to provide evidence of the quality of the goods. To be able to supply machinery for export, many suppliers have to pass quality tests conducted by significant organizations such as SGS, Veritas, or Intertek.

Import of second-hand clothing

Second-hand stores in Serbia are not regulated by any particular business legislation; they operate as specialized businesses for the sale of used products. Importers of used clothing are exempt from the requirement to obtain special permits for the import of waste, thanks to a special law issued by the Ministry of Environmental Protection. Only one requirement must be met: the clothing must be categorized, cleaned, and of “as new” quality.

Similar rules apply to lower-quality clothing, which may have some stains. In the case of footwear, there is an exception to this rule. Since the owner cannot disinfect and restore used footwear to a high standard, it is classified as garbage and cannotbe imported into Serbia for resale or humanitarian purposes.
Second-hand clothing is purchased by the kilogram from wholesalers, most of whom are based in the Czech Republic, Slovakia, and Germany, while used machinery is imported from all over the world.

Several factors will determine which mode of transport is appropriate for importing your used items. Dimensions, quantity, supplier region, price, and time sensitivity are just a few of the considerations when deciding whether to use a single truck, a groupage line, a ship, or air freight.

The Incoterms (International Commercial Terms) are simply rules that specify which party in the supply chain is responsible for certain duties, expenses, and hazards related to the shipment of products.

Pricing for sea freight shipments differs according to whether you are transporting a full container load (FCL) or less than a container load (LCL). Full containers usually come at a standard price. If you are shipping less than one container, the price will be charged per cubic meter. This makes shipping by sea freight one of the most cost-effective options – not only for large and heavy goods, but also for smaller shipments.

For many shippers, transportation costs seem to be an enigma. Cost calculation is far more complex than the cost of transport from point A to point B, because it includes additional elements, too. Most carriers will only offer you the price of transport, which does not mean that your goods will be delivered to the final destination. For this, you will have to choose other subcontractors. The International Air Transport Association (IATA) defines a valuable cargo as one whose value per kilogram exceeds $ 1,000 (USD). Nonetheless, there are often situations where different transport service providers have their own different internal policies on what a valuable shipment is. In addition to the total price of the goods being transported, the amount of customs duty to be paid also needs to be taken into account.

The sender’s request to have his cargo delivered on time, with complete security and minimal risk of loss or theft, can be particularly challenging in cases of high value cargo, when the stakes increase exponentially.

If you plan to exhibit at a trade show abroad, do not forget these important items – transport of goods and the necessary accompanying papers. It is necessary to think about the transport of the stand, products, samples, literature…
As with everything, this part requires proper preparation so that the delivery goes smoothly and so that your materials are where they should be in the agreed time span and in “one piece”. Trade show transport requires a longer time frame than traditional transport. You may need to ship the product and other materials weeks, even months in advance.

This further requires that you will need to have a warehouse on site where your goods will be stored until the trade show itself. When your goods arrive at the warehouse, calculate the cost of temporary storage of goods, as well as the additional fee for delivery to your stand.

When it comes to choosing the right truck for your goods, there are several key factors to keep in mind: from the weight and dimensions up to the quantity and type of goods. Below, we will outline the types of truck your freight forwarder might suggest for transports of standard goods.

Choosing the right type of truck is important to ensure the safety and security of your cargo and to keep transport costs low. There are different costs involved in hiring a pickup, van or truck. In addition, prices will depend on whether you book a whole truck load (FTL) or only a part of the space (LTL), or opt for groupage transport.

If you are transporting smaller quantities, a van can be a good option. Vans weighing up to 3.5 t do not have a tachograph, which gives them an advantage over larger vehicles. Their capacity ranges from 1,000 to 1,500 kg, or four to eight EUR-pallets (approx. 10-15 m³). The cargo space is usually around 4 m long, 2 m wide and 1.6 to 2 m high.

If you do not have enough cargo for a regular full truck load, but do not want to use groupage transport, you could also opt for a small truck. Trailers of small trucks are usually 6-7 m long, up to 2.4 m wide and up to 2.7 m high. They can transport up to 3,300 kg and have room for 15 to 18 EUR-pallets (35-40 m³).

Standard tarpaulin trucks come with trailers that are 13.6 m long, 2.4 m wide and up to 2.8 m high. With a cargo capacity of up to 24,000 kg and a volume of up to 90 m³, they offer room for 33 EUR-pallets. Mega trucks are slightly larger than ordinary trucks and are often used for bulky goods. Their trailers are 13.6 m long, 2.48 m wide and up to 3 m high. They can hold a volume of up to 100 m³.

For bulky goods of lower weight and higher volume, tandem trucks can be a suitable option. Tandem trucks have two trailers, each of which is usually 7.5 to 8 m long, 2.45 meters wide and up to 3 meters high. Their total capacity is up to 24,000 kg or 38 EUR-pallets (120 m³).
In addition to these options for standard goods, there are special vehicles for oversized and heavy cargo, temperature-sensitive goods (frigo trucks) or construction materials such as dirt and gravel (dump trucks). Finally, there are also special semi-trailers which are used to transport cargo in coils, such as steel coils.

The processing of wood and timber products has significantly contributed to the growth of industrial production in Serbia in the first nine months of 2021. Some of these products are for domestic needs, while others are exported. It is interesting to note that we have exported large quantities of unprocessed, but also processed wood to China.

The Serbian timber industry is extremely export-oriented and has significant development potential. According to data from the Republic Bureau of Statistics, in the period from January to May 2021, the export of furniture and products made of wood, cork, straw and paper amounted to 546.8 million euro, which makes up 6.6% of total exports of the Republic of Serbia. Compared to the same period in the previous year, exports grew by 13.3%. In the same period, imports reached 464 million euros. The most impressive output from this industry is made up by exports of furniture, which amounted to a value of 230.8 million euro.

The documents required for exporting wood differ from country to country, and they also depend on what level of processing the goods have undergone. In addition to the standard documents for trade, transport, insurance and customs, exporters should check the required additional requirements in the destination and transit countries, such as certificates, labeling on packaging, fumigation of packaging etc.

Depending on the level of processing, the destination and transit country and the purpose of the given products, it might be necessary to perform additional checks, such as phytosanitary inspections. Therefore, it is best to inform yourself about these requirements early on in the planning phase. In addition, all semi-finished wood products, depending on their tariff number, must be accompanied by a statement confirming that they are not produced from protected species of flora and fauna.

The vast majority of goods can be transported by seafreight using containers. This includes food, beverages, chemicals, plastics, rubber, textiles, wood, paper, metal, machinery, furniture, cars, electronics and many other things – from raw materials and machines to finished products.

When sending an inquiry to your freight forwarder or carrier, it is good to know the basic types of containers so that you can make the right choice according to your needs.

Most seafreight vessels carry 20 ‘or 40’ containers. These standard containers or all-purpose containers are suitable for any general cargo, mostly packed on euro pallets or in boxes.

A twenty-foot container can hold a maximum of 21,727 kg, or eleven standard EUR pallets with 120×80 cm each. Forty-foot containers can hold a maximum of 26,780 kg, or 24 EUR pallets. If you do not have enough cargo to fill an entire container (FCL), you can opt for consolidated transport (LCL).

High cube containers are structurally similar to standard containers, but taller. Just like standard containers, they can be used to ship all kinds of cargo. However, they are especially suitable for lightweight, high-volume or bulky cargo.
Of course, special containers are used for specific goods. Refrigerated or “reefer” containers have their own electric cooling / heating units and can be used to transport chilled or frozen goods. They are ideal for transporting vegetables, fruits, flowers, meat, milk and dairy products. Open top containers are used for packing and unpacking goods from above or through a door with a crane, as well as for transporting high loads.
Flat rack containers only have walls at the short ends of the container. They are especially suitable for heavy, high or oversized loads that cannot fit into a standard container. The walls of these containers are strong enough to withstand the necessary cargo securing attachments. It is also possible to stack multiple of these containers on top of each other.

The platform container, which has no walls at all, is an ideal solution for heavy and oversized cargo that cannot be transported using a flat rack or open top container. Flexitank containers are used to transport bulk and liquid cargoes, such as edible oil, fruit syrups and concentrates, oil additives or detergents.

Temporary or permanent work assignments, studying abroad or returning home – there are many reasons for transporting personal effects or furniture across the border. No matter what the motive may be, it is always important that they arrive at their destination safely and on time.

If you want to transport your personal belongings abroad, start by making a detailed list with an approximate value of each item. All items must be listed by packaging unit (box, crate, bag, etc.), and each packaging unit needs to be clearly marked and numbered. This list is handed over to the freight forwarder, who will prepare the documents for the customs authorities.

The choice of transport method will depend on the shipment volume, the destination, and on how quickly you need your items delivered.Road transport can be a cost-effective option for closer destinations. You can have a truck or van hired exclusively for your needs, or make use of groupage transport.

For overseas destinations, seafreight is the most economical option. You can book a full container or make use of consolidated transport, sharing a container with other shippers. Some forwarders will require special wooden crates, while others also accept cardboard boxes or suitcases.

If you have only a few boxes and need them shipped as quickly as possible, airfreight is the simplest option. Airlines will charge based on the actual or “calculated weight” of your shipment, whichever is higher. The calculated weight in kg is determined as follows: length x width x height in centimetres, divided by 6,000.

Leaving Serbia? If you are planning to take books, paintings and other art objects out of the country, you will require special permissions. For works of art and all other objects older than 50 years, permission must be obtained from the Institute for the Protection of Cultural Monuments of Serbia. In the case of books and publications, it is issued by the National Library of Serbia.

Returning to Serbia? If you are a citizen of Serbia and have been working abroad for a minimum of two years, you may be exempt from some or all import duties on your personal effects and furniture. Your logistics provider can assist you in preparing the required documents.

First of all, you should have your own warehouse or a signed storage contract with a company that offers warehouse space approved by the veterinary inspection to store this type of goods.

The goods are reported to the Veterinary Inspection at the border crossing and sent to the above-mentioned warehouse, where they will be placed under customs or veterinary supervision until the end of the customs clearance procedure.

If it is a food supplement, i.e. the product is not characterized as medicine, no additional registration is required. However, the goods will still need to be cleared through customs based on the statement of the importer confirming the categorization of the product.

You have probably often heard that the import procedure for certain equipment, works of art or musical instruments requiresapplying for an ATA carnet.

What is this about?

An ATA carnet, also called a “passport for goods”, is a customs document which is used to simplify temporary import procedures into a foreign country, with a validity period of one year.

Using an ATA carnet, goods are transferred quickly and easily (without hiring a customs agent and freight forwarder), but certain rules must be followed:

– the goods will be re-exported / imported in the same condition as they were temporarily imported / exported

– the goods will remain the property of a person with residence outside the country of temporary admission

– the goods will be used exclusively by a person visiting the area of the temporary import (not intended for rental)

It is important to mention that ATA carnet cannot be used for the temporary import of food and other perishable goods, and is most commonly used for imports of the following three categories:

– temporary import of samples

– temporary import of professional equipment

– temporary import of goods intended for exhibitions, fairs, congresses and similar events

This includes:

computers, repair tools, musical instruments, sports equipment, scenography, concert sound, medical instruments and more.

Foodstuffs producers who export their products to Central Europe or the Far East regularly send samples to potential customers. Fruits, vegetables and pastry products can generally be transported fresh, frozen or dry. In the case of fresh or frozen goods, transport has to be arranged under temperature-controlled conditions, using specialized carriers.

While larger quantities of chilled or frozen goods are usually shipped in temperature-controlled containers or “Envirotainers”, smaller shipments are transported in special boxes and cooled with dry ice. Air transport has a clear advantage over sea transport in this case, since it is significantly faster. Dry ice shipments are subject to a number of restrictions, since airlines classify them as dangerous goods (DG). Although dry ice does not cause damage by itself, it is considered a hazardous substance and requires documentation and handling by trained personnel to ensure compliance with IATA restrictions.

Another method of transporting temperature-sensitive goods is with gel packs. These are packages of liquid refrigerant that absorb heat and maintain a constant temperature. In contrast to dry ice, gel packs are not categorized as dangerous goods, but they are more expensive. No matter which method you choose, it is essential to plan ahead and contact your logistics provider early to ensure that the transport can be organized efficiently.

Since January 1, 2021, the United Kingdom is no longer a member of the EU and has “third country status” with a separate customs territory from the EU. Although the EU and UK signed a free trade agreement, there are still significant changes in documentation and processes that must be followed in order for the EU and UK to trade with each other.

All imports and exports of goods between the UK and the EU are now subject to customs procedures. As each EU jurisdiction has its own reporting model, these procedures can differ depending on transport mode and port of exit/entry.
